General Conditions of Service

 

These General Terms and Conditions are valid from January 1st, 2017, until revocation and govern the contractual relationship between the company, “WTMR”, and any subscriber (hereinafter referred to as “Customer”) on the appearance in the catalog WTMR SELECTION. The following conditions shall apply to the service provided by WTMR.

 

1. Publication

The English version of these general conditions is available online without restriction, on the website www.wtmr.org.

 

2. Definition of the service

WTMR provides continuous information about its services on its website, which does not constitute an offer. By sending a letter of solicitation to the Customer, WTMR offers the customer to be included in the publication WTMR catalog which will be published in the current calendar year. The first WTMR catalog will be published in April 2019 and annually thereafter. WTMR shall publish the entry as approved by the USPTO. The published catalog is a purely promotional publication which will be distributed in the USA. WTMR shall send the Customer a copy of the catalog as a proof of execution of contract.

 

3. General conditions of contract

3.1. Acceptance of contract

The contract is based on receipt of payment and reference number after a letter of offer is sent to the Customer by WTMR constituting an offer of service.

 

3.2. Completion of contract

Once the contract is accepted, following the offer from WTMR and the payment by the Customer, WTMR shall publish a catalog including an entry approved by the USPTO. WTMR shall send the Customer a copy of the published catalog as a proof of execution of contract.

 

3.3. Catalog issue schedule

The deadline for inclusion in the annual catalog is set for December 31st. The date of publication is scheduled for April. Publication distribution is carried out continuously for a minimum of four weeks from the date of printing.

 

4. Rights and obligations of the Customer

4.1. Termination of contract, refund of fees

The Customer has the right to terminate the contract in writing for any reason, and get a refund of the service fee paid. The Customer may terminate the contract before the date of closure of the catalog, i.e. December 31st of any given year. In the event of termination, WTMR agrees to reimburse the Customer the full amount of the service fee. In case of termination of the contract by the Customer, additional bank charges are to be shouldered by the Customer. WTMR shall reimburse the Customer up to the amount of the service fee paid.

 

4.2. Managing customer requirements

If the Customer would like additional data added to the catalog entry, in addition to the information specified in the letter of offer, WTMR must be notified of the details in writing. Following a separate consultation and mutual agreement, WTMR shall strive to meet the needs of the Customer to the best of its abilities.

 

 4.3. Data verification

The order sheet sent to our potential customers contains all the necessary information for creating the entry. A proof will only be sent for review upon request of the Customer. The Customer must notify WTMR in writing via e-mail or US mail before the date of closure about any incorrect or invalid data contained on the order sheet. WTMR cannot be held responsible for any errors in the catalog entry resulting from failure to notify WTMR.

 

4.4. Managing complaints against content and quality

WTMR is not obliged to consider or accept claims. WTMR is not liable for any errors in content or quality of the published version due to error or omission.

 

5. Rights and obligations of WTMR

WTMR agrees to proceed as defined in these terms when providing service. WTMR will fully respect the content of these general conditions, and is responsible for any breach of this obligation.

 

5.1. Provision of service

WTMR is obligated to perform the service ordered by the Customer. WTMR publishes the catalog in accordance with technical parameters provided on its website, and aims to ensure the perfect quality of the content, form and printing of the publication. WTMR agrees to send a copy of the published catalog to professional associations.

 

5.2. Responsibility of WTMR

WTMR is not liable for any errors in content, quality or printing of the published version.

 

5.3. Termination of contract

WTMR has the right to terminate the contract after notifying the customer in writing. In this case, WTMR will reimburse the Customer the full amount of the service fee paid. In case of termination of the contract by WTMR, additional bank charges are to be shouldered by WTMR.

 

5.4. Providing free copy

WTMR agrees to send a free copy to each Customer of the current edition of the catalog. Additional copies will be available within the limits of available stock. Inquire about additional copies and costs.

 

6. Prices and payment terms

Applicable service fees are outlined in WTMR’s letter of offer. Once the service fee is paid, WTMR is required to perform the service accepted by the Customer. The Customer may use WTMR’s letter of offer/solicitation as an invoice. At the Customer’s request WTMR will send an invoice and a W-9 form via email or mail.

 

7. Privacy Protection

The Publisher shall use all reasonable means to protect the Customer’s privacy, including all information that the Customer provides when using WTRM’s website, and further agrees not to release any information to any third person, as well as not to sell, share, release or disclose the contents of its database which contains information about the Customer. WTMR reserves the right to collect the following information: (I) name, job title and e-mail address of Customer’s contact person, (II) demographic information such as US zip code, preferences and interests, and (III) other information relevant to customer surveys and/or offers.

 

Publisher shall use Customer’s information for the following purposes: (I) Internal record keeping, (II) improving its products and services, (III) periodically sending promotional mail about new products, special offers or other information which WTMR believes may be of interest to the Customer, and (IV) contacting Customer for market research purposes.

WTMR will make every reasonable effort to ensure that the Customer’s information is secure, and to prevent unauthorized access or disclosure.

WTMR reserves the right to change its policy from time to time, any changes will be set forth on its website.

 

8. Disclaimer

Information contained in the WTMR website have been obtained from sources believed to be reliable. However, neither WTMR nor its authors guarantees the accuracy or completeness of any information.
